Chapter 13 - Commercial Building Electrical Code

13.01 ELECTRICAL INSPECTOR

(1) Appointment. The Electrical Inspector shall be appointed by the Village Board as provided in Sec. 2.02(1) of the Village Code. The Electrical Inspector may be the same person as the Building Inspector. For inspections on public buildings the Electrical Inspector shall retain a State Commercial Electrical Inspector License. (2) Powers and Duties. The Electrical Inspector shall have the power and duty to enforce the provisions of this chapter and of all other ordinances, laws, and orders of the State of Wisconsin or of this Village which relate to the installation of electrical services, and for these purposes, s/he shall have the right at all reasonable times to enter buildings and premises.

(3) Deputy Inspectors. The Village Board may appoint deputy electrical inspectors and may delegate to them any of the above-mentioned powers and duties.

13.02 STATE CODE ADOPTED

Wis. Adm. Code ILHR 16 and 24 are hereby adopted by reference and made part of this Chapter and shall apply to the construction and inspection of new one and two family dwellings and additions or modifications to existing one and two family dwellings. (O-94-01)

13.03 PERMIT

No electric wiring or other equipment shall be installed or altered without first securing a permit therefore from the Electrical Inspector, except that repairs or replacements of broken or defective sockets, switches or base receptacle, may be made without a permit. The application for such permit shall be on a form furnished by the Electrical Inspector and shall state clearly the work planned, alterations to be made, and equipment and materials to be used, and all later deviations from such plan must be submitted to and approved by the Electrical Inspector. The permit shall be obtained by the electrician or party doing the work covered by the permit. Any person doing electrical work in connection with the project for which s/he has obtained a building permit under Chapter 12 of the Village Code shall not be required to obtain a separate permit under this section. There shall be a flat fee of $3.00 for each electrical permit issued.

13.04 PENALTIES

Any person violating any of the provisions of this chapter may be enjoined from continuing such violation and shall, upon conviction, be subject to a forfeiture of not less than $25.00 nor more than $500.00, together with the cost of prosecution. Every day during any part of which any person or group of persons fail to observe or comply with any provision of this chapter shall constitute a separate and district violation. Any person who shall fail or neglect to comply with any lawful order of the Electrical Inspector issued pursuant to the provisions of this chapter shall be deemed guilty of a violation of this chapter, and every day or fraction thereof on which such person shall fail or neglect to comply with such order shall be deemed as a separate offense.

13.05 REVIEW OF ELECTRICAL INSPECTOR DETERMINATION

Review of any determination by the Electrical Inspector shall be had according to the procedures specified in Chapter 68, Wis. Stats.

13.06 SEVERABILITY

If any provision or part thereof of this chapter or of the Wisconsin State Electrical code shall be adjudged unconstitutional or invalid, the remaining portions thereof and provisions shall not be affected thereby.
