15.01 STATE CODE ADOPTED.
The Village of Deerfield hereby adopts the code provisions established by the Wisconsin Department of Industry, Labor and Human Relations with respect to safe storage, installation, operation, use, maintenance and transportation of flammable and combustible liquids, as such standards and requirements are set forth in the Wisconsin Administrative Code at Chapter ILHR 10 ("DILHR 10") and as may be amended from time to time. The Village Clerk shall keep a copy of DILHR 10 on file at the Village Hall.
15.02 ENFORCEMENT RESPONSIBILITY.
The Chief of the Deerfield Volunteer Fire Department shall have primary enforcement responsibility and authority with respect to DILHR 10.
(1) Coordination with Village Building Inspector. The Village Building Inspector shall advice the Chief of any violations known to the Village Building Inspector or any requests for permits that fall within DILHR 10. The Village Building Inspector shall then work with the Chief to insure that violations are remedied and permits properly issued.
(2) Assignment of Specific Inspection Responsibilities. In those situations where specific certification is required and/or the Chief believes that assignment of inspection responsibilities will enhance the safety, health and welfare of the Village, the Chief may request and assignment of the specific inspection responsibilities to a duly certified inspector. Such request shall be presented to the Village Board for consideration and approval. No assignment shall be effective without approval of the Village Board. Approval shall be evidenced by resolution of the Village Board.
15.03 FEES.
The fees charged for inspections, testing and other procedures required by DILHR 10 shall be set by resolution of the Village Board. A copy of said resolution shall be provided to the Chief of the Deerfield Volunteer Fire Department.
15.04 PENALTIES.
Any person or persons violating any provisions of this chapter shall, upon conviction, be subject to a forfeiture of not less than $10.00 and not more than $500.00, together with costs of prosecution. Each and every day during any part of which any person or group of persons fail to observe and comply with any of the provisions of this chapter shall constitute a separate and distinct violation of this chapter. In addition, any person violating any provision of DILHR 10 may also be subject to any and all penalties set forth in DILHR 10.
