Chapter 17 - Municipal Judge

17.01 OFFICE OF MUNICIPAL JUDGE CREATED

Pursuant to the authority granted by Wis. Stats., Sec. 755.01 (1977), there is hereby created the office of Municipal Judge for the Village of Deerfield.

17.02 ELECTION AND TERM

The Municipal Judge shall be elected at large at the spring election, commencing with the April, 1980 election, for a term of two years commencing on May 1 of the year of his election.

17.03 OATH AND BOND

The judge shall, after election or appointment to fill a vacancy, take and file with the Clerk of the Circuit Court for Dane County the official oath as prescribed by Wis. Stats., Sec 757.02(1) (1977), and at the same time execute and file a bond of $1,000.00.

17.04 SALARY

The Municipal Judge shall receive a salary as determined from time to time by the Village Board, which shall be in lieu of fees and costs. No salary shall be paid to the judge for any time during his term for which he has not executed and filed his official bond and oath as required by Section 17.03 of this ordinance.

17.05 JURISDICTION

The Municipal Judge shall have such jurisdiction as provided by Wis. Stats., Sec. 755.045 (1977).

17.06 PROCEDURE

(1) Sessions of Court. The court of the municipal judge shall be called the “Municipal Court for Deerfield, Wisconsin” and shall be open on the second and fourth Thursdays of each month beginning at 7 p.m.

(2) Where Sessions Held. The Municipal Judge shall keep his/her office and hold court in the municipal building.

(3) Collection of Fines, etc. The Municipal Judge shall collect all forfeitures, fines and taxable costs in any action or proceeding before him and shall pay over such monies to the Village Treasurer not later than the second business day succeeding his receipt thereof.

17.07 VACANCIES

(1) Permanent. A permanent vacancy in the office of Municipal Judge shall be filled by election as provided by Wis. Stats., Sec. 8.50 (1977).

(2) Absence Considered Permanent. A municipal Judge cannot be absent from his duties for more than 8 consecutive weeks. If said judge is absent from his office longer than 8 weeks, his vacancy shall be considered permanent.

17.08 CONTEMPT OF COURT

(1) Definition. “Contempt of court” means:

(a) Intentional misconduct in the presence of the court which interferes with a court proceeding or with the administration of justice, or which impairs the respect due the court; or

(b) Intentional disobedience, resistance, or obstruction of the authority, process, or order of a court; or

(c) Intentional refusal as a witness to appear, be sworn, or answer a question; or

(d) Intentional refusal to produce a record, document, or other object; or

(e) Any other action as defined in section 785.01, Wis. Stats., as amended from time to time.

(2) Forfeiture. Pursuant to section 800.12, Wis. Stats., as amended from time to time, the Municipal Judge may impose a forfeiture for contempt of court in an amount not to exceed the limit established by the Wisconsin Statutes, and may, upon non-payment of this forfeiture plus the penalty assessment under section 165.87, Wis. Stats., impose a jail sentence not to exceed seven (7) days.
