Chapter 27 - Village Parks

27.01 PURPOSE

This ordinance is intended to establish minimum standards of conduct within the Village of Deerfield parks so as to secure the maximum benefit of the park facilities to the majority of the citizens of the Village of Deerfield. The standards established hereby are intended to supplement, rather than supplant or supersede, any other existing portions of the Deerfield Village Code.

27.02 DEFINITIONS

For purposes of this chapter, the following words shall have the following meanings:

(1) Parks. “Parks” shall mean all land and rights thereto including water, improvements, and personal property thereon which is designated as a portion of the Village of Deerfield park.

(2) Commission. “Commission” shall mean the Village of Deerfield Parks Commission as established by the Deerfield Village Board.

(3) Person. “Person” shall mean any individual, firm, partnership, corporation, or other association or group of individuals.

27.03 LIABILITY

Any person using or occupying any portion of a Village park or any part thereof shall be liable for damage or injury to the park or property thereon or to its personnel occasioned by the activities or occupancy of that person regardless of whether that occupancy occurs by formal lease or by use of the park as a public place. The penalty for violating any provision of this chapter shall be as specified in section 23.04, Deerfield Village Code.

27.04 MINIMUM STANDARDS OF CONDUCT

It shall be a violation of this chapter or any person, while on or about the Village of Deerfield parks to:

(1) Make use of the parks or any part thereof, while part of an organized group, unless the prior express approval of the Commission has been obtained.

(2) Drink or possess any fermented malt beverage or intoxicating liquor after the hour of 10:00 p.m. or before the hour of 8:00 a.m., except without the prior approval of the Commission.

(3) Sell any fermented malt beverage or intoxicating liquor without obtaining express written approval of the Commission and without obtaining any other necessary license.

(4) Be in the parks between the hours of 11:00 p.m. and 7:00 a.m., without express prior approval of the Commission.

(5) Dispose of refuse or litter, except in receptacles provided for that purpose.

(6) Deface, damage, or alter the appearance of any structure, property, sign, or equipment.

(7) Build fires at any location other than fire pits or grills. (Any such fires must be completely extinguished before leaving the site.)

(8) Allow any animal to run at large or allow any animal to endanger the safety of any other person.

(9) Throw stones, beverage containers, or any other type of object capable of causing damage to property or injury to persons. (This shall not prohibit any recreational activities; however, the throwing or kicking of any ball, frisbee, or other similar item must be in such a manner so as to respect the rights or other persons using the parks.)

(10) Possess or discharge any firearm or any other weapon of any kind.

(11) Possess, use, or dispense any controlled substance in violation of Wisconsin Statues, including the Uniform Controlled Substances Act, as contained in Chapter 161, Wis. Stats.

(12) Act in such a manner as to be abusive, boisterous, or disorderly.

(13) Use any sound amplification device, sound track, loudspeaker, radio, stereo, or other device in such a manner as to produce excessive, loud, or unusual noises so as to annoy, harass, or disrupt the peaceable use of the park.

27.05 ENFORCEMENT.

(1) Any employee or agent of the Commission or any other authorized law enforcement officer may revoke any permit or license to use a park when, in his or her reasonable judgment, persons or property on or within the park may be endangered by the continuance of the exclusive use provided under the license or permit.

(2) Persons in charge of any reservation shall be responsible for the conduct of those in attendance, which shall include disallowing alcoholic beverages to minors, maintaining the general safety of those attending, and maintaining the cleanliness of the public property under use.

(3) Any law enforcement officer may arrest an offender whom he may detect in the violation of any of the provisions of this chapter. Such officer shall have at all times the right to enter the premises of any building, structure, or enclosure in any park for the purpose of inspection or investigating disturbances.
