Chapter 2 - Officials

2.01 ELECTED OFFICIALS

(1) Trustees. There shall be six (6) trustees of the Village of Deerfield, not including the President. Three (3) trustees shall be elected at each annual spring election for the term of two (2) years, commencing on the third Tuesday in April of the year of their election. All trustees shall be elected at large.

(2) Village President. The Village President of the Village of Deerfield shall be chosen at the regular spring election in odd numbered years for a term of two (2) years, commencing on the third Tuesday in April of the year of his/her election.

(3) Municipal Justice. The Village Municipal Justice shall be chosen at the regular spring election in odd numbered years for a term of two (2) years commencing on May 1 of the year of their election.

(4) Removal of Office. All elected officials shall be subject to removal under Wis. Stats. § 17.13(2) (1977).

(5) Wards. Pursuant to section 5.15(2), Wis. Stats. (1979-80), the entire Village of Deerfield shall constitute a ward. The polling place for the Village shall be the Village Fire Station unless modified by resolution of the Village Board prior to any affected election.

2.02 APPOINTED OFFICIALS [O2000-10, 12/11/2000]

(1) Appointments.

(a) How Made. All appointed officials shall be appointed by the Village President and subject to the approval of the Village Board, unless otherwise specifically provided by ordinance, resolution or contract approved by the Village Board.

(b) When Made; Length of Appointment. Unless otherwise specifically provided by ordinance, resolution or contract approved by the Village Board, all appointments shall be made at the first regular meeting in April and all appointments shall run for a two (2) year period commencing on May 1st.

(c) Removal from Office. Unless otherwise specifically provided by ordinance, resolution or contract approved by the Village Board, all appointed officials shall be subject to removal under Wis. Stats. § 17.13(1).

(2) Village Administrator-Clerk-Treasurer. The offices of Village Administrator, Village Clerk and Village Treasurer shall be consolidated into a single office. The Administrator-Clerk-Treasurer shall be appointed by the Village President, subject to confirmation by the Village Board. Following his or her appointment, the Administrator-Clerk-Treasurer shall take office. If deemed appropriate by the Village Board, the Administrator-Clerk-Treasurer shall serve in accordance with a written job description or contract approved by the Village Board. If the Village Board does not expressly approve a written job description or contract, the Administrator-Clerk-Treasurer’s duties shall include those duties customarily associated with the positions and his or her service shall continue at the pleasure of the Village Board for an indefinite term.

(3) Village Attorney. The Village Attorney shall be appointed by the Village President, subject to confirmation by the Village Board. Following his or her appointment, the Village Attorney shall take office. If deemed appropriate by the Village Board, the Village Attorney shall serve in accordance with a written retainer agreement or contract approved by the Village Board. If the Village Board does not expressly approve a written retainer agreement or contract, the Village Attorney’s duties shall include those duties customarily associated with the position and his or her service shall continue at the pleasure of the Village Board for an indefinite term.

(4) Village Engineer. The Village Engineer shall be appointed by the Village President, subject to confirmation by the Village Board. Following his or her appointment, the Village Engineer shall take office. If deemed appropriate by the Village Board, the Village Engineer shall serve in accordance with a written retainer agreement or contract approved by the Village Board. If the Village Board does not expressly approve a written retainer agreement or contract, the Village Engineer’s duties shall include those duties customarily associated with the position and his or her service shall continue at the pleasure of the Village Board for an indefinite term.

2.03 GENERAL REGULATIONS GOVERNING ALL VILLAGE OFFICIALS

(1) Effect. The provisions of this section shall apply to all officers of the Village, regardless of the time of creation of the office or selection of the officer unless otherwise specifically provided by ordinance or resolution of the Village Board.

(2) Oath of Office. Every officer of the Village, including members of the Village Board, shall before entering upon his/her duties and within five (5) days of his/her election or appointment or notice thereof take the oath of office prescribed by law and file said oath in the office of the Village Clerk-Treasurer. Any person re-elected or re-appointed to the same office shall take and file an official oath for each term of service.

(3) Bonds.

(a) General. Every office shall, if required by law or the Village Board, upon entering upon the duties of his/her office, give a bond in such amount as may be determined by the Village Board with such sureties as are approved by the Village President, conditioned upon the faithful performance of the duties of his/her office. Official bonds shall be filed as are oaths as provided in ss. (2) of this section.

(b) Treasurers Bond. The Village of Deerfield does hereby elect not to give the bond of the Village Treasurer provided for by Wis. Stats. § 70.67(1) (1977) pursuant to Wis. Stats. s. 70.67(2) (1977). The Village of Deerfield shall pay, in case the Treasurer shall fail to do so, all taxes of any kind required by law to be paid by such Treasurer to the County Treasurer.

(4) Salaries. All officers of the Village shall receive such salaries as may be provided from time to time by the Village Board by resolution. No officer receiving a salary from the Village shall be entitled to retain any portion of any fees collected by him/her for the performance of his/her duties as such officer in the absence of a specific law or ordinance to that effect.

(5) Vacancies. Vacancies in elective offices shall be filled by appointment by a majority vote of all of the members of the Village Board for the remainder of the unexpired term at their discretion. Vacancies in appointive offices shall be filled in the same manner as the original appointment for the residue of the unexpired term of such office unless the term is indefinite.

2.04 PROHIBITING RECEIPT OF GIFTS OR GRATUITIES

(1) Receipt of Gifts Prohibited. It shall be unlawful for any public employee or public official to receive or offer to receive, either directly or indirectly, any gift, gratuity, or anything of value which he/she is not authorized to receive from any person, if such person:

(a) Has or is seeking to obtain contractual or other business or financial relationships with such public employee’s employer or the governmental body of the public official; or

(b) Conducts operations or activities which are regulated by such public employee’s employer or the governmental body of a public official; or

(c) Has interests which may be substantially affected by such public employee’s employer or the governmental body of a public official.

(2) Against Public Policy. The receipt of any gift, gratuity, or anything of value as denoted above is contrary to the public policy of the Village of Deerfield.

2.05 ELECTION OFFICIALS

There shall be no less than three (3) election officials at each poll place at each election. There may be up to, but no more than, seven (7) election officials appointed where it appears that election day registration will make additional officials necessary. Similarly, where it appears necessary, there may be alternate officials selected or two sets of officials selected to work at different times on a given election day. Election officials, inspectors and tabulators shall be qualified, appointed and selected in accordance with Wis. Stats. § § 7.30 and 7.32.
