9.01 STATE TRAFFIC LAWS ADOPTED
Except as otherwise specifically provided in this ordinance, all provisions of chapters 340 to 350 of the Wisconsin Statutes describing and defining regulations with respect to vehicles and traffic for which the penalty is a forfeiture only, including penalties to be imposed and procedure for prosecution, are hereby adopted and by reference made a part of this ordinance as if fully set forth herein. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this chapter. It is specifically understood that any and all amendments or additions to said referenced state statues are hereby and shall be adopted by and incorporated into this section 9.01.

9.02 SPEED LIMITS
The provisions of §346.57, 346.58 and 346.59 of the Wisconsin Statutes, relating to the maximum and minimum speed of vehicles are hereby adopted as part of this section as if fully set forth herein and as may be amended.
9.03 THROUGH STREETS DESIGNATED
The following streets in the Village of Deerfield, Wisconsin, in the interest of public safety are hereby declared to be through streets:
Main Street (State Highway No. 73) from the North Village limits to the South village limits; West Nelson Street from the West curb line of Western Avenue to the West curb line of Main Street; East Nelson Street from the East curb line of Main Street to the West curb line of High Street; West Deerfield Street from the East curb line of Western Avenue to the West curb line of Main Street; Liberty Street from the West village limits to the West curb line of Main Street; State Street from the West village limits to the West curb line of Main Street.
All vehicles proceeding in a westerly direction on North Street shall stop behind the crosswalk on Central Avenue; all vehicles proceeding in a westerly direction on West Deerfield Street shall stop behind the crosswalk on Western Avenue; all vehicles proceeding in a northerly direction on High Street shall stop behind the crosswalk on East Nelson Street; all vehicles proceeding in a northerly direction on Washington Street shall stop behind the crosswalk on East Nelson Street; all vehicles proceeding in any direction on Quarry Street and South Prairie Street shall stop behind the crosswalk before entering the intersection of Quarry Street and South Prairie Street.
9.04 VEHICULAR WEIGHT LIMITATIONS
(1) Class “B” Highways Designated. All streets and alleys in the Village are hereby designated as Class “B” Highways subject to the weight restrictions in Wis. Stats. §348.16, as may be amended, except for the following which shall remain Class “A” Highways subject to Wis. Stats. §348.15, as may be amended:
(a) Main Street (State Highway No. 73), throughout its entire length.
(b) North Industrial Park Drive to DNR Glacial Drumlin Bike Trail, Burdick Parkway, Enterprise Drive, Golf Road, Interpane Lane and Wedvick Road, throughout their entire length.
(c) West Nelson Street from Grand Avenue to Main Street only, except that milk trucks may use West Nelson Street throughout its entire length.
(d) Park Drive, throughout its entire length.
(e) West Deerfield Street, from Main Street (State Highway 73) to Park Drive.
(f) Washburn Road, from Main Street (State Highway 73) to Plaza Street.
(g) Plaza Street, throughout its entire length.
(h) Grand Avenue, north of West Nelson Street.
(2) Special or Seasonal Weight Limitations; Designation of Heavy Traffic Routes. In addition to any other restrictions which may apply, certain streets may be temporarily designated as heavy traffic routes and/or subject to additional special or seasonal weight restrictions. Such designations shall be made by resolution of the Village Board and shall be properly posted by the Director of Public Works in accordance with Wis. Stats. §§ 349.16 and 349.17, as may be amended.
(a) South Industrial Park Road from Main St. east, to the intersection of Golf Rd. is restricted to vehicles weighing over 8,000 lbs, other than emergency or maintenance vehicles.
(3) Heavy Traffic Routes
(a) The following streets in the Village are designated as heavy traffic routes per Section 349.17, Wisconsin Statutes:

3. Plaza Street
4. West Deerfield Street to Park Street
5. Park Street, north of West Deerfield Street
6. West Nelson, Street to Grand Avenue
7. Grand Avenue, north of West Nelson Street

9. Industrial Park Drive
10. Interpane Lane
11. Enterprise Drive
12. Golf Dive
13. Burdick Parkway
14. Future Rd.
(b) No person shall operate any “heavy traffic vehicle” on any street other than these specified in subsection (1) hereof, except when necessary to (i) obtain orders for supplies or (ii) move or deliver supplies or commodities to or from anyplace of business or residence. When it is necessary for an operator of a heavy traffic vehicle to travel upon a street not designated under subsection (1) hereof, such operator shall leave and re-enter such heavy traffic routes at the point closet to his immediate destination.
(c) As used herein, “heavy traffic vehicle” shall mean all vehicles not operating completely on pneumatic tires and all vehicles or combination of vehicles designed or used for transporting property of any nature and having a gross weight of more than 8000 pounds. Excluded from this definition are: (i) motor buses; (ii) farm vehicles; and (iii) vehicles which primary use is the transportation of dairy products or farm produce.
(d) Appropriate signs shall be erected to give notice of the designation of streets in subsection (1) hereof as heavy traffic routes.
9.05 LOADING AND UNLOADING RESTRICTIONS
(1) Truck Regulations. It shall be unlawful for any person to park, load or unload any semi-tractor-trailer combination motor vehicle upon Main Street of the Village of Deerfield between the intersection of Main Street with the DNRGlacial Drumlin Bike Trail, and the intersection of Main Street with Liberty Street for more than twenty (20) minutes.
(2) Automobile Regulations. It shall be unlawful for any person to park, load or unload any motor vehicle upon Main Street in the Village of Deerfield between the intersection of Main Street with the DNR Glacial Drumlin Bike Trail, and any intersection of Main Street with Liberty Street, unless such parking, loading or unloading be made in or from a regularly designated parking space. This section shall not apply to motor vehicles which are a part of any funeral procession providing such vehicles are parked within an area marked by appropriate signs.

9.06 OFFICIAL TRAFFIC SIGNS AND SIGNALS
(1) Erection of Official Traffic Signs and Signals. The police chief, upon advice and authorization of the Village Board, shall direct the director of public works to procure, erect and maintain appropriate standard traffic signs, signals and markings conforming to the rules of the state highway division. Such notice of the provisions of sections 9.02 through 9.06 of this ordinance shall be given as required by state law. Other signs, signals, or markings shall also be erected in such locations and manner as authorized by the Village Board as to give adequate warning to users of the street, alley or highway in question.
(2) Removal of Unofficial Signs and Signals. The director of public works shall have the authority granted under Wis. Stats., § 349.09, “Authority to Remove Prohibited Signs and Signals”, pertaining to signs, signals, markings or devices placed, maintained or displayed in violation of this ordinance or Wis. Stats., § 346.41. Any charge imposed on a premise for the removal of such an illegal sign, signal or device shall be reported to the Village Board at its next regular meeting for review and certification.
(3) Designation of Location of Stop Signs. In the interests of public safety, traffic stop signs have been erected and shall be maintained at the following locations to control traffic upon highways and roads under the exclusive jurisdiction of the Village:

9.07 PARKING REGULATIONS
(1) All-Night Parking Prohibited. No person shall park any vehicle for a period of time longer than 30 minutes between hours of 2:00 a.m. and 6:00 a.m. of any day from October 1 to May 1 except physicians on emergency calls, on any of the following streets:
Any part of Main Street (State Highway No. 73) .
(2) All-Day Parking. No vehicle is allowed to be parked on the same side of the street for a continuous period of 24 hours.
(3) Parking on Certain Village Streets Prohibited. Parking is prohibited on the streets listed below to the extent noted.
(a) No person shall park any vehicle on the east side of Park Drive between Nelson and Deerfield Streets.
(b) No person shall park on either side of North Industrial Park Road between Main Street and Interpane Lane. [O-95-07]
(c) No person shall park any vehicle on the south side of Legreid Street. [O-95-07]
(d) No person shall park on either side of Industrial Park Road from Main Street on the west to West Alley on the east, a distance of approximately 125 feet. [O-95-07]
(e) No person shall park any vehicle on either side of East Quarry Street from South Main Street to Center Street. [O-95-07]
(f) No person shall park on Main Street either North of the Glacial Drumlin Bike Trail or South of Liberty Street. [O-95-07]
(g) No person shall park any vehicle on designated emergency snow routes during such time as an emergency has been declared. [O-96-04]
(h) No person shall park any vehicle on the west side of Center Street between Legreid and Lake Streets. No person shall park any vehicle on the east side of Center Street between Legreid and Lake Streets except in the designated diagonal parking spaces and the two designated parallel parking spaces. (i) No person shall park any vehicle on any alley right-of-way in the Village. [O-2000-09, 12/11/2000]
(j) No person shall park any vehicle on the south side of Lake St from the Center St. intersection running east 190 feet.
(k) No person shall park any vehicle on the north side of South Industrial Park Rd. from Main St. to the DNR Glacial Drumlin Bike Trail nor on the south side of South Industrial Park Rd. from High St. to the DNR Glacial Drumlin Bike Trail.
(l) No person shall park any vehicle on the north side of Liberty Street from Main Street to Grand Avenue nor on the south side of Liberty Street from Main Street to Bue Street.
(4) Limited Parking. Parking shall be limited on the streets listed below to the times noted.
(a) There shall be a two (2) hour parking limit in the following areas of Main Street between the hours of 8:00 a.m. and 6:00 p.m., except Sundays and Holidays: on the west and east sides from the DNR Glacial Bike Trail path to the intersection with Liberty Street, except one public parking space in front of the Village hall which will be limited to thirty (30) minutes. ( b) There shall be one (1) handicapped parking stall on Main Street marked by the Police Department.
(c) Any handicapped person may apply to the Police Department for a special permit allowing for extended parking in restricted zones upon presentation of medically supported evidence of significant disability.
(5) Towing. All vehicles found in violation of parking regulations under 9.07 may be towed away at the owner’s expense.
(6) Alternate Side Parking. In addition to particular restrictions contained in Chapter 9 of the Deerfield Village Code (especially Section 9.07 - Parking Regulations) and Chapter 5 of the Village Code (especially Section 5.08 - Snow and Ice Removal), the following restrictions shall apply between November 15 and April 15. No person shall park, stop, or leave standing any vehicle between the hours of 1:00 a.m. and 7:00 a.m. on the even numbered side of the street on the odd numbered calendar days and on the odd numbered side of the street on the even numbered calendar days except as posted otherwise. The Public Works Director shall have the responsibility to instruct staff to erect appropriate signs designating the restrictions. Portions of street which prohibit parking at all times on one side of said street and which permit parking of any status on the other side of said street shall be excepted from the provisions of this section.

(7) Parking on Designated Municipal Holidays. For purposes of parking enforcement of this section 9.07, the designated municipal holidays are the same as those allowed and listed in the Employee Manual.

(8) Parking at Intersections in Downtown Business District. There shall be “No Parking” “Trucks, Vans, Utility Vehicles and SUV’s” on Main St. in the first stall at all corners of the intersections of Nelson St. and Deerfield St. except for the handicap parking stall in front of Village Hall, 4 N. Main St.
9.08 BICYCLE REGULATIONS
(1) State Bicycle Laws Adopted. The following Wisconsin Statues describing and defining regulations with respect to bicycles are hereby adopted and made a part of this ordinance by reference:

(2) Riding Bicycles on Sidewalks
(a) Children under 10 years of age may ride bicycles on public sidewalks and may not ride bicycles in public streets, except as follows: no bicycles may be ridden on public sidewalks along Main Street between Liberty Street and north to the DNR Glacial Drumlin Bike Trail; instead, children under 10 years of age may ride bicycles along Park Drive.
(b) Children between the ages of 10 and 12, inclusive, may ride bicycles on public sidewalks or in public streets, except none may be ridden on public sidewalks along Main Street between Liberty Street and north to the DNR Glacial Drumlin Bike Trail.
(c) Except as permitted in the foregoing paragraphs (a) and (b), no bicycles may be operated on any public sidewalks.
(3) Licensing of Bicycles. No bicycle shall be operated within the Village of Deerfield unless the same has been licensed by the Village. All licenses shall be issued by the Police Department. The license fee for one year shall be $3.00. All licenses shall expire on the 30th day of April of each year of their expiration and shall be attached to the rear portion of the bicycle.
(4) Powers of Police. Any Village police officer shall have authority to suspend the license of or impound any bicycle operated contrary to any Village ordinance; such suspension or impoundment to continue for a period not to exceed 10 days.
9.09 PENALTIES
(1) General Rule. Any person who shall violate any of the provisions of this ordinance shall, upon conviction thereof, forfeit not less than $20.00 nor more than $500.00, except as provided in subsection (2).
(2) Specific Rules.
(a) The maximum forfeiture for a violation of any provision of section 9.05 of this ordinance shall be $25.00.
(b) The penalty for violation of any provision of section 9.07 hereof shall be $25.00; provided, a $15.00 reduction shall be granted for payment within ten days, including the day the citation was issued.
(c) The maximum forfeiture for a violation of any provision of section 9.08 of this ordinance shall be $10.00 or the court may prohibit the person found guilty of violating section 9.08 for riding a bicycle for a period not to exceed six (6) months.

9.10 ENFORCEMENT
(1) Stipulation of Guilty or No Contest. Stipulation of guilt or no contest may be made by the person arrested for violations of this chapter in accordance with Wis. Stats. §66.0114(1)(b), as may be amended, except as provided in Wis. Stats, §345.20 to §345.53 (1977). Stipulations shall conform to the form contained on the uniform traffic citation and complaint under Wis. Stats. §345.11 (1977), and may be accepted within five (5) days of the date of the alleged violation. Stipulations may be accepted by the Village Police Department.
(2) Deposits. Any person stipulating guilt or no contest under subsection (1) of this section must make the deposit required under §345.26, Wis. Stats., or, if the deposit is not established under such statute, shall deposit a forfeited penalty as provided in the schedule established by the Chief of Police and approved by the Village Board. Deposits may be brought or mailed to the office of the Police Department as directed by the arresting officer. Deposits for parking or non-moving violations shall be mailed or brought to the Village Clerk.
(3) Forfeitures in Treasury. Any officer accepting deposits or forfeited penalties under this chapter shall deliver then to the Village Treasurer within three (3) days after receipt.
9.11 UNNECESSARY VEHICLE NOISES
No person shall make unnecessary and annoying noises with a motor vehicle by the squealing of tires, excessive acceleration of the engine, or by emitting unnecessary loud noises.
9.12 USE OF DYNAMIC BRAKING DEVICES PROHIBITED [098-03, 7/13/98]
(1) Definition. A dynamic Braking Device (commonly referred to as jake brakes, jacobs brake, engine brake, or compression brake) means a device primarily on trucks for the conversion of the engine from an internal combustion engine to an air compressor for the purpose of braking without the use of wheel brakes.
(2) Use Prohibited. It is unlawful for any person to operate any motor vehicle with a Dynamic Braking Device engaged, except for the aversion of imminent danger within the Village limits.
